Welcome to LibOrbit ("LibOrbit", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the LibOrbit website, applications, and Library Management Software as a Service (SaaS) platform.
By creating an account or using LibOrbit, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Service refers to the LibOrbit Library Management Platform.
Customer refers to any library, school, college, university, organization, or institution using LibOrbit.
User means any administrator, librarian, staff member, or authorized individual accessing the platform.
Content means all information stored or uploaded by customers, including books, members, transactions, reports, and related data.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
By registering, you represent that all information you provide is accurate and complete.
You are responsible for:
Maintaining accurate account information.
Keeping login credentials secure.
Restricting access to your account.
All activities performed under your account.
You must notify us immediately if you suspect unauthorized access.
LibOrbit offers various subscription plans with different features and usage limits.
Subscription details, pricing, billing cycles, and available features are displayed on our pricing page.
Some features may only be available under specific plans or as paid add-ons.
If you purchase a paid subscription:
Fees are charged in advance.
Payments are processed through authorized payment providers.
Taxes may apply depending on your location.
Failure to pay may result in suspension or termination of service.
Subscriptions renew automatically unless canceled before the renewal date.
Customers are responsible for maintaining valid payment information.
Customers may cancel their subscription at any time.
Cancellation prevents future renewals but does not automatically entitle the customer to a refund for the current billing period unless required by applicable law.
Unless otherwise required by law:
Subscription payments are non-refundable.
Partial billing periods are not refunded.
Add-on purchases are non-refundable after activation.
You agree not to:
Violate any applicable law.
Attempt unauthorized access to any system.
Upload malware or harmful software.
Interfere with platform performance.
Abuse APIs or system resources.
Reverse engineer or copy the platform.
Use LibOrbit for fraudulent or illegal activities.
Customers retain ownership of all data they upload.
LibOrbit does not claim ownership of your books, members, reports, or other library information.
You grant LibOrbit permission to process your data solely for providing the Service.
We perform regular backups to improve service reliability.
However, customers are encouraged to maintain independent backups of important data.
LibOrbit is not responsible for data loss resulting from customer actions, third-party failures, or events beyond our reasonable control.
We strive to maintain high service availability but do not guarantee uninterrupted access.
The Service may occasionally be unavailable due to:
Scheduled maintenance
Emergency maintenance
Infrastructure issues
Internet outages
Force majeure events
LibOrbit, including its software, design, logos, branding, source code, documentation, and content, is protected by intellectual property laws.
Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works based on LibOrbit.
LibOrbit may integrate with third-party providers such as:
Payment gateways
Email services
SMS or WhatsApp providers
Cloud hosting providers
Analytics tools
Your use of those services is governed by their respective terms and policies.
We may suspend or terminate accounts if:
These Terms are violated.
Fraudulent or illegal activity is detected.
Payment obligations are not met.
Continued use threatens platform security or stability.
Upon termination, access to the Service may be removed.
To the maximum extent permitted by law, LibOrbit shall not be liable for:
Loss of profits
Business interruption
Data loss
Indirect or consequential damages
Losses arising from third-party services
Our total liability shall not exceed the amount paid by the customer for the Service during the twelve (12) months preceding the claim.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
LibOrbit makes no warranties, express or implied, regarding uninterrupted availability, accuracy, or fitness for a particular purpose.
You agree to indemnify and hold harmless LibOrbit, its employees, affiliates, and partners against claims, damages, liabilities, and expenses arising from:
Your misuse of the Service.
Violation of these Terms.
Violation of applicable laws.
Infringement of third-party rights.
We may modify, improve, discontinue, or update features at any time to maintain and enhance the platform.
Where practical, we will provide reasonable notice of material changes.
We may revise these Terms periodically.
Updated versions will be published with a revised Effective Date.
Continued use of LibOrbit after changes become effective constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
